Terms of Service — Flourish Société

Please read these Terms of Service ("Terms") carefully before using flourishsociete.com (the "Site") or purchasing from Flourish Société ("we", "us", "our"). By placing an order or using our Site, you agree to be bound by these Terms.

Flourish Société is a handmade flower crown and floral accessory business based in South Melbourne, Victoria, Australia.

2. Our Products

All Flourish Société crowns are individually handmade using premium artificial florals.
Drop pieces are one-of-one and once sold, that exact piece cannot be repurchased or exchanged for an identical item.
"Recreate This Look" custom orders are made to order, inspired by a previously sold or displayed piece. Due to natural variation in wholesale floral stock, custom pieces may differ slightly in exact shade, stem type, or placement from the original photographed item, see our Returns & Refunds Policy for details.
Colours may appear slightly different in person due to screen display settings and lighting in product photography.
We reserve the right to limit quantities, discontinue a product, or update pricing and product descriptions at any time without prior notice.

3. Pricing & GST

All prices displayed on the Site are in Australian Dollars (AUD) and are inclusive of GST, as Flourish Société is a registered business for GST purposes.
We reserve the right to change prices for future drops at any time. Prices at the time of purchase are what apply to your order.
In the rare event a pricing error occurs on the Site, we reserve the right to cancel any order affected and issue a full refund.

4. Weekly Drops & Ordering

New pieces are released via scheduled "drops," generally on a daily or weekly basis. Drop times, quantities, and pieces available are at our discretion and may change without notice.
Drop pieces are sold on a first-come, first-served basis. Adding an item to your cart will reserve it for a set time shown on the cart page to allow you time to finish adding items to your cart and process your payment. However, the sale is only confirmed once checkout is completed and payment is successful. If you do not finalise your purchase by the end of the reserve time, it will be made available for other customers to add to their cart.
Due to the high-demand nature of drops, occasional stock discrepancies may occur (e.g. a piece sells out between adding to cart and completing checkout). If this happens, we'll notify you and issue a full refund for the affected item.
Orders placed and paid before the daily dispatch cutoff (see our Shipping Policy) will be dispatched same-day; orders placed after this time will be dispatched the following business day.

5. Payment

Payment is required in full at the time of ordering via the payment methods offered at checkout.
By providing payment details, you confirm you are authorised to use the payment method provided.
We use third-party payment processors to handle transactions securely and do not store your full payment card details on our systems.

6. Shipping

Shipping is currently available to addresses within Australia only. Shipping costs, timeframes, and free-shipping thresholds are outlined in our Shipping Policy, which forms part of these Terms.

7. Returns & Refunds

Our approach to returns, exchanges, and refunds, including special terms for one-of-one drop pieces and custom "Recreate This" orders, is set out in our Returns & Refunds Policy, which forms part of these Terms. Nothing in these Terms limits your rights under the Australian Consumer Law.

8. Intellectual Property

All content on the Site — including photography, product descriptions, logos, and design elements — is owned by Flourish Société unless otherwise stated, and may not be copied, reproduced, or used commercially without our prior written permission.
Customer photos shared with us (e.g. via social media tags or reviews) may be reposted or used in our marketing with credit given, unless you request otherwise.

9. Acceptable Use

When using our Site, you agree not to:

use the Site for any unlawful purpose or in a way that could damage or impair its functioning;
attempt to gain unauthorised access to any part of the Site or our systems;
use automated means (e.g. bots) to purchase drop pieces or interfere with the fairness of the drop process;
misuse or scrape our content, images, or pricing information for commercial purposes.

We reserve the right to cancel orders or restrict access to the Site for any user found to be in breach of these Terms.

10. Limitation of Liability

To the maximum extent permitted by law, Flourish Société is not liable for any indirect, incidental, or consequential loss arising from your use of the Site or purchase of our products, including delays caused by third-party couriers. This clause does not exclude any rights or guarantees you have under the Australian Consumer Law that cannot lawfully be excluded.

11. Privacy

Our collection and use of your personal information is set out in our Privacy Policy, which forms part of these Terms.

12. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, products, or legal requirements. The version in effect at the time of your order will apply. We recommend checking this page periodically.

13. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes arising from these Terms or your use of the Site will be subject to the jurisdiction of the courts of Victoria, Australia.
